USER AGREEMENT

TERMS

The following terms are used in this Agreement: 

user- a legally capable individual above the age of 18 and wishes to register on the Company’s website for the purpose of reviewing, accepting the offer and/or any other actions stipulated by the functions of the Company’s website; 

 

website – the Company’s Internet resource, located at: https://elleuzbekistan.com

website administrator – a legal entity LLC “GEMINA PUBLISHING” (hereinafter referred to as the “Company”), registered in accordance with the legislation of the Republic of Uzbekistan, acting as a Means of Mass Information (hereinafter referred to as “mass media”) on the basis of the Certificate of electronic media registration No. 260078 dated 22.04 .2024.

TERMS OF USE

  1. The subject of the User Agreement (hereinafter referred to as the “Agreement”) is to provide the User with access to the functionality of the website.
  2. The Website provides the User with the following functionality: 
  • Access to search and navigation tools of the website;
  • Access to materials posted on the site free of charge;
  • Access to creating a User account;
  • Access to social interactions (featured materials, share materials, liked materials);
  • Access to pre-ordering media content;
  • Access to subscription to information and marketing mailings;
  • Access to cookies setting;
  • Access to changing the website language (ENG, RU, UZB). 
  1. The agreement is a public offer. By accessing the website, the User agrees to all the terms of the Agreement. In case of disagreement, the User must immediately stop using the website.
  2. The use of materials and services of the website is regulated by the current legislation of the Republic of Uzbekistan.
  3. All materials on the website are the property of the Company and/or its partners. The company owns exclusive rights to intellectual property, including texts, photographs, audiovisual materials, graphics, trademarks, logos, etc.
  4. The User acknowledges that the “ELLE” brand is a trademark and the User may not use the trademark without obtaining the written consent from the Company.
  5. The user agrees and undertakes not to take actions that may be considered as violating the legislation of the Republic of Uzbekistan and other international legal acts in the field of intellectual property, copyright and related rights ratified by the Republic of Uzbekistan, as well as any actions that lead and/or may lead to a violation of normal performance of the website and the Company.  
  6. The user has the right to use website materials freely for personal reference (receive and display the content from the website on a computer or smartphone screen). 
  7. Any other use of website materials, wholly or partially, including text, heading, subtitle, photographs, video, audio materials, illustrations, animations and other materials is permitted only with the written permission of the Company.   
  8. Partial or complete use of text/photographic/video materials posted on the website is not permitted
  9. If permission to copy, distribute, publish or use legally protected website materials in any other way is obtained, such copying, distribution, publication or other use is not permitted without an active link to the material itself in the first or second sentence of the text. Directly below the used material there should be a byline: “source _________ (name of website)”. 
  10. Any editing of photographs, videos, illustrations and other materials from the website is prohibited. 
  11. Persons, who unlawfully used the materials, published on the website, are responsible for unauthorized copying and use of materials in accordance with the current legislation of the Republic of Uzbekistan.
  12. The User may not infringe the copyright, trademark, trade secret or any other personal or proprietary right of any third party.
  13. The Company, at its sole discretion, has the right to restrict access to Users who violate the copyright and other legally protected rights of others, and also reserves the right, but is not obligated, to review, edit, move or delete any material posted by Users on the website, at its own discretion and without notice.
  14. The company and its affiliates do not represent or guarantee uninterrupted access to the website, as well as the absence of failures, errors, deficiencies or loss of transmitted information, and the impossibility of viruses while using the service. 
  15. The Company and its affiliates are not liable to the User or any third parties for any direct, indirect, special, consequential or fine damages arising from access or inability to access the website, including liability for viruses, which can be acquired while using the website or information and materials on the website, regardless of the type of claim or nature of the claim, even if there is no notice of the possibility of such damages.
  16. The User accepts the provision that all materials and services of the website or any part thereof may have advertisements. The User agrees that the website administration does not bear any responsibility and does not have any obligations in connection with such advertising.
  17. The User who believes that his rights and interests have been violated due to the actions of the Administrator or third parties in relation with the posting any materials on the website, sends a claim to the Administrator at: [email protected]
  18. The Company reserves the right to change the Agreement from time to time. Use of this website constitutes the User’s agreement to all changes and amendments to the Agreement, therefore it is advisable to check this page periodically. 

The User confirms that they have read all the points of this Agreement and accepts them unconditionally. 

In case of disagreement, the User must immediately stop using the website.
